1. Acceptance of Terms
By accessing or using RaiseHQ (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Description of Service
RaiseHQ provides software tools that enable political campaigns and committees (“Campaigns”) to collect and process political contributions from donors. RaiseHQ is not a bank, payment processor, or financial institution. Payment processing is provided by Stripe, Inc. under Stripe’s own terms of service.
3. Eligibility
You must be at least 18 years old to use RaiseHQ. By creating an account, you represent that you have the authority to bind the committee or organization on whose behalf you are registering.
4. Campaign Responsibilities
Campaigns using RaiseHQ are solely responsible for:
- Compliance with all applicable federal, state, and local campaign finance laws, including but not limited to FEC regulations and applicable state agency requirements;
- The accuracy of all information provided on donation forms;
- Timely filing of all required campaign finance reports with the appropriate regulatory agencies;
- Maintaining appropriate records as required by law;
- Refunding contributions that exceed applicable legal limits.
5. Platform Scope
RaiseHQ’s compliance tools are limited to transaction-time contribution limit enforcement and clean data export. RaiseHQ does not:
- File campaign finance reports on behalf of campaigns;
- Provide legal advice;
- Guarantee compliance with campaign finance laws;
- Monitor for pre-election reporting obligations.
6. Fees
RaiseHQ charges a platform fee of 0.5% on each processed contribution. Payment processing fees are charged separately by Stripe. Fees are non-refundable except as required by law.
7. Prohibited Uses
You may not use RaiseHQ to:
- Accept contributions from foreign nationals;
- Accept contributions that exceed applicable legal limits;
- Circumvent campaign finance laws;
- Engage in fraud or misrepresentation;
- Make false or misleading claims in fundraising solicitations;
- Process contributions for organizations not registered as political committees where required;
- Violate OFAC sanctions, anti-terrorism laws, or international trade controls.
8. Refunds
RaiseHQ does not hold, process, or have access to contribution funds. All contribution funds flow directly to campaigns’ connected Stripe accounts. Refunds are initiated by the campaign in Stripe; the RaiseHQ dashboard links to the relevant Stripe screen. RaiseHQ automatically reverses the contribution in its records when a refund is processed.
9. Intellectual Property
RaiseHQ and its content are owned by RaiseHQ LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without written permission.
10. No Agency Relationship
Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between RaiseHQ and you. RaiseHQ does not endorse any campaign, candidate, or political position.
11. Disclaimer of Warranties
The Platform is provided “as is” without warranties of any kind. RaiseHQ does not warrant that the Platform will be error-free or uninterrupted.
12. Limitation of Liability
To the maximum extent permitted by law, RaiseHQ shall not be liable for any indirect, incidental, special, or consequential damages. RaiseHQ’s total liability shall not exceed the fees paid by you in the twelve months preceding the claim. The foregoing limitations do not apply to liability arising from gross negligence, willful misconduct, fraud, or death or personal injury caused by negligence.
13. Indemnification
You agree to indemnify and hold harmless RaiseHQ from any claims arising from your use of the Platform or violation of these Terms.
14. Force Majeure
RaiseHQ is not liable for failure or delay in performance caused by events outside our reasonable control, including natural disasters, government actions, infrastructure outages, or cyberattacks.
15. Termination
RaiseHQ may suspend or terminate your account at any time for violation of these Terms or for any other reason with or without notice.
16. Dispute Resolution
Any dispute arising from these Terms shall be resolved by binding arbitration under JAMS rules in San Francisco, California, except that either party may bring claims in small claims court for disputes under $10,000. You waive the right to participate in class action lawsuits. You have 30 days from first accepting these Terms to opt out of arbitration by emailing [email us].
17. Governing Law
These Terms are governed by the laws of the State of California.
18. Changes to Terms
RaiseHQ may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms.
